This 6-month programme aims to provide education and training in common law and DIFC laws and courts procedures to civil law lawyers, DIFC Courts practitioners, Emirati advocates, In-house counsels and other professionals whose work involve exposure to common law systems and jurisdictions. OVERVIEW

The DIFC Laws Certificate programme aims to provide education and training in Common Law and DIFC laws and procedures to Emirati advocates, civil law trained lawyers and other professionals whose work involves exposure to common law systems and jurisdictions. The course consists of several sections that can be taken together as a whole or as individual components.

The sections are as follows:

 Unit 1 - English Common Law by Middlesex University Dubai- Faculty of Law 

English Legal System Principles of Common Law; Contract Law; Tort Law; Company Law; Employment Law; ADR, Arbitration; Data Protection Law; and Equity Law. 

This course will be presented by the Law professors of Middlesex University Dubai. It aims to provide education and training in English Common Law, Basic Advocacy and Legal Drafting to civil law lawyers, DIFC Courts practitioners, Emirati advocates, In-house counsels and other professionals whose work involves exposure to common law systems and jurisdictions.

 

 Unit 2 - DIFC Courts Procedures by DIFC Legal Practitioners 

Overview of the DIFC Courts and procedural topics. 

The series of lectures will be presented by Experts and Specialists from DIFC Academy School of Law comprised of senior partners from leading global legal firms. It aims to provide education and training on the DIFC Laws and DIFC Courts Procedures to civil law lawyers, DIFC Courts practitioners, Emirati advocates, In-house counsels and other professionals whose work involve exposure to common law systems and jurisdictions. 

 

 Unit 3.1 - Advocacy Basics by Middlesex University Dubai and SOL International  (sessions are included in the English Common Law module)

 

 Unit 3.2 - Advanced Advocacy by Outer Temple Chambers  

Court etiquette; trial advocacy and witness handling and examination; oral and written submissions and appeals advocacy

 

 Unit 4 - Legal Drafting Skills by Middlesex University Dubai  (sessions are included in the English Common Law module)

 

 Unit 5 - Legal Tech by Middlesex University Dubai 

Legal technology foundations

 

 Unit  6 - Climate Law by Middlesex University Dubai 

Climate Law foundations and principles; Climate Law litigation

 

 Unit 7 - Tax Law by Aurifer Team 

UAE Tax Law; Applications of tax legislation; Implications of tax legislation for legal practitioners 

 

 Unit 8 - ADR & Arbitration by Middlesex University Dubai 

Overview of ADR, Mediation; International Arbitration; Arbitration in the UAE

 

 Unit 9 - Cryptocurrencies & Dispute Resolution by KBH 

Overview of regulatory regime for crypto and issues arising in litigation

 

LEARNING OUTCOMES

On completion of programme, participants should be able to:

  • Understand and explain the operation of the English legal System
  • Demonstrate a knowledge of areas of substantive English common law such as contract law, tort, company law, law of agency, land law, law of trusts, as well as employment law and arbitration
  • Demonstrate knowledge of DIFC laws and procedures, particularly company and insolvency, trust and foundations, employment, real property, and arbitration

Upon completion of the course, participants should acquire several skills relevant and necessary to practicing law within the DIFC and exercising rights of audience before the DIFC Courts. Such skills include the ability to:

  • Research, evaluate and retrieve information from a variety of sources
  • Analyse, synthesise and apply the law in common law settings
  • Draft legal documents in common law settings
  • Make oral submissions in common law settings

 Others 

  • Units can be taken together or as individual components
  • Special 10% discount for full course registrations valid until 31 March 2024
  • 8 Accredited CLPD points for Dubai Legal Affairs Department (DLAD) registered practitioners 
  • Emirati Advocates who complete the full course and related assessments and obtain the Certificate of Completion, may be eligible to register with the DIFC Courts. For further information and registration requirements, please refer to the DIFC Courts website

 

ADMISSION AND REGISTRATION

 

DURATION

     6 MONTHS (with holiday and summer breaks)

 

ENTRY REQUIREMENTS*

     1. Curriculum Vitae

         Please submit a copy of your most recent CV demonstrating your work experience to date.

     2. A Bachelor’s Degree

         Candidates holding a higher education degree other than law can be considered eligible. Please submit a copy of your degree certificate or transcripts. In the absence of a bachelor’s degree, candidates will need to demonstrate significant exposure to the legal profession and/or legal practice through their employment. Please submit an additional document with your CV explaining how you are eligible in lieu of a bachelor’s degree.

      3. Clear command of the English language

       This requirement is important, especially for the advocacy part of the course. To satisfy this requirement, candidates need to submit an undergraduate or graduate degree completed in English.

       If the completed degree is not in English, ONE of the following should be submitted:

  • A cover letter (500 words) justifying your interest for the course
  • A TOEFL or IELTS certificate demonstrating achievement of a good score

  • Option 3: 6,000 AED - DIFC Courts Procedures (30 hours; 18 sessions)
  • Option 4: 7,000 AED - Advanced Advocacy + Basic Advocacy + Legal Drafting (36 hours; 12 sessions)
  • Option 5:  1,200 AED - Legal Tech (6 hours; 3 sessions)
  • Option 6:  1,200 AED - Tax Law (6 hours; 3 sessions)
  • Option 7:  1,600 AED - ADR and Arbitration (8 hours; 4 sessions)
  • Option 8:  1,200 AED - Cryptocurrency Regulation & Dispute Resolution (6 hours; 3 sessions)
  • Option 9:  800 AED - Climate Law (4 hours; 2 sessions)

  3. Fill out and send signed registration form to academy@difc.ae.
  4. Select mode of payment and payment scheme.
  5. Pay the initial registration fee (5,000 AED*)
  6. Receive registration confirmation from DIFC Academy

                      *Registration fee is non-refundable but deducted from the total course fee.
