The DIFC Law No. 1/2007 has been largely modelled on the privacy and data protection principles and guidelines which stem from the relevant EU directives that were in force at the time of the data Protection Law’s enactment (primarily EU Directive 95/46/EC), and EU Directives continue to be a model for general guidance to the Commissioner in the administration of the Data Protection Law. As a result, this law has been inspired in part by data protection legislation in the UK and EU and parts of it mirror specific provisions in these jurisdictions.

Jonathan Kirsop is a London-based partner who leads the firm's global data protection and information law practice and is known for providing pragmatic and practical advice assisted by his experience on secondment at the UK Information Commissioner's Office and certain global banks. Jonathan provides advice on a wide range of international data protection matters including GDPR compliance, international data transfers, subject access requests and disclosures to regulators.  He is a regular visitor to Dubai where he works with the Stephenson Harwood office in delivering data privacy advice and training particularly in the context of employment matters.

Kiersten Lucas is a Dubai-based partner and heads the Dubai employment team.  She is a highly regarded and valued member of the firm's international elite-ranked employment team and is known for providing commercial, pragmatic solutions tailored to her clients' needs. She has extensive experience advising on all aspects of the employment lifecycle, with particular expertise in high value litigation, restrictive covenants/protection of confidential information, data protection and privacy, the employment law aspects and implications of regulatory contraventions (including LIBOR and FX manipulation and market abuse), remuneration arrangements and senior executive appointments and terminations. Her work regularly involves matters spanning multiple jurisdictions, including parallel litigation or investigations. As well as providing operational and strategic advice to clients under both UAE and free zone-specific employment legislation (such as the DIFC), she is an excellent public speaker and regularly delivers bespoke training sessions, including on the employment aspects of data protection and privacy.

Emily Aryeetey

Emily is a Dubai-based Associate having moved across from the firm's London office, initially on a long-term secondment. Emily is an experienced employment law specialist with a background of advising employers and employees on data protection issues both in the UK under the Data Protection Act 1998 and in the UAE (both in relation to complying with DIFC and UAE federal laws relevant to employee privacy and data protection) particularly in relation to transferring data out of the jurisdiction and harmonising global data protection policies for international clients. Her UK experience had particular focus on advising employers on complying with requests for data subject access and also on issues arising in the context of corporate transactions, recruitment, and on the termination of employment when processing and disclosing personal data to prospective employers, government agencies and other third parties.

Alison Kenney

Associate, Stephenson Harwood

Alison Kenney is a member of the firm's internal data protection team and has significant experience advising on data protection issues, including in relation to subject access requests and direct marketing. Alison’s recent experience includes assisting a global bank with a gap analysis of its banking terms and fair processing notices against legislative changes being brought about by the GDPR as well as delivering training to HR professionals in Dubai on the requirements of DIFC and UAE privacy laws.
