This 2-hour webinar session will provide an overview of the remedies available under the Damages Law, a discussion of the DIFC Courts’ approach to anti-suit injunctions, and a discussion of the DIFC Courts’ approach to awarding punitive or triple damages. ALEXANDRA LESTER

Alex is a Legal Director in the Dubai office of Clyde & Co’s Dispute Resolution Group. She assists clients to resolve complex commercial disputes arising across a range of sectors with particular specialism in disputes arising in the technology, telecommunications, media, entertainment, and real estate sectors. Alex's experience includes representing clients at every stage of dispute resolution proceedings including in the DIFC Courts, local UAE Courts, English Courts, arbitration (under the DIFC-LCIA, ADCCAC, ICC and LCIA rules), negotiation and mediation. Alex also regularly advises on commercial and contractual issues arising in day-to-day business operations, such as managing project delay, late payment, agency disputes, and contract terminations.

Alex is a Solicitor of England and Wales and a registered practitioner before the DIFC Courts.

Prior to becoming a lawyer, Alex worked at IBM UK Limited for 5 years as a Commercial Manager, and so has first-hand experience of commercial disputes from a client perspective. She has also undertaken secondments to the legal departments of retail and banking clients.

NICOLA JACKSON

Nicola is a Legal Director in Clyde & Co's Dispute Resolution Group and is based in Dubai. She has been in the region since 2010 and has extensive experience acting for both local and international clients on commercial and financial disputes before courts and tribunals in the UAE, Bahrain, Oman and Saudi Arabia. In particular, Nicola specialises in banking disputes and is acting on a number of high-profile cases before the DIFC Courts including the first ever “Courts of Dubai” ‘opt in’ case pursuant to Article 5(A)(2) of the Judicial Authority Law which came before the DIFC Court of Appeal. Nicola has also acted on DIFC Courts proceedings in a claim against BR Shetty and NMC Healthcare LLC. Nicola was successful in obtaining worldwide freezing and provision of information orders (followed by successful judgments) in both cases. 

Nicola has acted for the Central Bank of Bahrain in her previous firm's capacity as external administrator of The International Banking Corporation and advised on a wide range of litigation across various jurisdictions, including claims for fraud and breach of contract. Nicola has acted for clients in international arbitrations under the ICC, LCIA and GCCCAC Rules and the Oman Arbitration Act, with a particular focus on arbitrations involving parties from or with interests in the Middle East.

Roya is an Associate in Clyde & Co’s Dispute Resolution Group, and is based in Dubai having joined the firm in 2016.

Roya’s experience include advising and acting on behalf of clients in commercial disputes in the onshore, DIFC and ADGM Courts, as well as in international arbitrations (DIFC-LCIA, ICC, LCIA and DIAC). Roya’s experience covers a range of sectors, with specific focus on disputes arising out of the automotive, technology and construction sectors. Additionally, Roya regularly advises clients on enforcement of foreign judgments and arbitration awards in the UAE.
