The DIFC Law Reports - 2015/2016

Published in conjunction with the Academy of Law, the DIFC Law Reports 2015-2016 is the latest edition of the DIFC Courts official law reports in bound form. It cases included within it have been specially selected for their particular significance and legal importance with the help of Natasha Bakirci, Assistant Registrar: DIFC Courts, David Gallo, Director Academy of Law and Jacques Visser, DIFC Chief Legal Officer,

In each the law report includes a case summary written by an All England Law Report trained Court Reporter.

As a result of changes to the DIFC Courts’ jurisdiction in 2011, parties from anywhere in the world, regardless of whether they have any ostensible connection to the DIFC, are able to opt-in to the DIFC Courts’ jurisdiction in the context of civil and commercial matters. This has led to a significant increase in the numbers of cases being heard in these courts and there has also been a rise in the average value of cases from 24.2 million US dollars in 2015 to 28.5 million US dollars in 2016.

Certain themes have emerged in the cases heard in 2015–2016, further defining the parameters of the DIFC Courts’ jurisdiction (and are reported on in this book), including whether the DIFC Courts may be used as a ‘conduit’ for enforcement of foreign judgments in the Dubai Courts, provision for third party funding in the DIFC, Islamic banking, the doctrine of forum non conveniens and its applicability in the context of DIFC related cases and the interpretation and the practical effects of Article 18 of the DIFC Employment Law.
